1. ACCEPTANCE OF TERMS

3. PROFESSIONAL ARBORIST SERVICES & LIMITATIONS

Truly Arbor Care provides professional arborist services, including diagnostic evaluations and plant health care recommendations, based on:

• observable site conditions at the time of inspection

• professional judgment

• arboricultural science

• applicable ISA, ANSI A300, and TCIA standards

Trees, shrubs, and plants are living organisms. Their health and structural condition are influenced by variables beyond our control, including but not limited to weather, soil conditions, pests, disease progression, environmental stress, and property modifications.

NO GUARANTEE OF BIOLOGICAL OUTCOMES

• All evaluations and recommendations are professional opinions, not guarantees.

• No warranty, expressed or implied, is made regarding tree health, recovery, disease eradication, longevity, or prevention of failure.

• Conditions may change after inspection, including sudden failure or decline.

4. DIAGNOSTIC & CONSULTING DISCLAIMER (CRITICAL)

• Arborist diagnoses are based on visual assessment, testing when applicable, and probability—not certainty.

• Some diseases, disorders, or defects may not be detectable at the time of evaluation.

• Laboratory testing may be recommended but does not guarantee definitive results.

• Client acknowledges that arborist recommendations represent informed guidance, not assurances.

5. TREE RISK ASSESSMENT DISCLAIMER (TRAQ)

When applicable, risk assessments follow ISA Tree Risk Assessment Qualification (TRAQ) methodology.

• Tree risk assessment is probabilistic, not predictive.

• Trees can fail without warning despite professional evaluation.

• Risk mitigation reduces—but does not eliminate—risk.

• Client accepts residual risk after services are performed.

6. EDUCATIONAL CONTENT DISCLAIMER

All Website Content is provided for educational and informational purposes only.

• Website materials are not a substitute for on-site professional evaluation.

• Information should not be used for self-treatment, pruning, or chemical application without consultation.

• Truly Arbor Care is not responsible for damages resulting from misuse or misinterpretation of educational content.

7. CLIENT RESPONSIBILITIES

The Client agrees to:

• disclose known site conditions, prior work, underground utilities, irrigation systems, and past tree issues

• maintain recommended post-service care

• understand that failure to follow recommendations may impact outcomes

8. PAYMENT TERMS

• Payment terms are specified in service agreements or invoices.

• Unless otherwise stated, payment is due upon completion or per agreed schedule.

• Late payments may incur reasonable fees consistent with Texas law.

• Returned payments may incur administrative fees.

9. CANCELLATION & TERMINATION

• Cancellation policies are specified per service agreement.

• Once professional services have begun (including evaluations, consultations, or site visits), fees may be non-refundable.

• Either party may terminate services if conditions make continuation unsafe, impractical, or unethical.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by Texas law:

• Truly Arbor Care shall not be liable for indirect, incidental, consequential, or special damages.

• Liability, if any, is limited to the amount paid for the specific service giving rise to the claim.

• The Company is not responsible for property damage or injury resulting from natural tree failure, weather events, or conditions beyond reasonable control.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Truly Arbor Care, its owners, employees, and agents from any claims, damages, or expenses arising from:

• misuse of services or information

• failure to follow recommendations

• site conditions not disclosed by the Client

12. PRIVACY & DATA USE

We respect your privacy. Information collected through this website or services is used solely for business operations and communication. We do not sell personal data. Third-party platforms may be used for forms, analytics, or communications.

13. INTELLECTUAL PROPERTY

All website content, logos, images, text, and materials are the intellectual property of Truly Arbor Care and may not be reproduced without written consent.

15. FORCE MAJEURE
